BZA approves accessory dwelling and multiple variances for property in Tempertsville area

Staff explained the application requires variances for setback distances, maximum accessory-dwelling size and lot-size minimums; staff recommended approval of the special-use permit with seven conditions if the board wished to grant variances. Board members reviewed prior approvals relating to the parcel (two units approved historically) and concluded the replacement double-wide met local circumstances with the recommended conditions. The motion to approve the special-use permit and the three variances was made, seconded, and approved by voice vote.
Conditions include obtaining required county permits, compliance with the plotted plan, VDOT and Health Department compliance, a certified and staked survey, site maintenance until certificate of occupancy, county inspection rights until occupancy is issued, and nullification of the permit/variance if conditions are violated.
