Maybrook trustees assume SEQRA lead agency for Galaxy subdivision, adopt negative declaration

Maybrook Mayor Dennis Leahy opened a special meeting at 6:00 p.m. on Feb. 26, 2026, and the board took up a revised "Galaxy" subdivision application. Project engineer Jane Samuelson said the revised plan reduces six proposed development lots to three lots now, "that can be subdivided later," and reviewed document changes intended to reflect recent annexation and prior reviews from 2021–2022.
Attorney Liz Cassidy summarized the environmental review status, saying the project had been treated as a Type I action under SEQRA, that "more than 30 days have elapsed since the circulation of the notices" and that the village has proof of mailing. Trustee Giannico moved to assume lead agency; Trustee Capozzoli seconded the motion and the board voted unanimously "5 Ayes, 0 Nays," according to the transcript.
Cassidy and Engineer Sean Hoffman reviewed redline edits to the prior negative declaration and noted updates to clarify where acreage lies inside the Village and where it lies in the Town of Montgomery. Cassidy told the board that it does not have jurisdiction over parcels located in the Town of Montgomery but is entitled to review impacts: "as a board, that you do not have jurisdiction over any piece that's in the Town of Montgomery that impacts the parcel," she said.
The board then voted to accept the negative declaration as amended. The transcript records that motion as "Motion by Trustee Capozzoli, seconded by Deputy Mayor Woznick, to accept the negative declaration as amended. 5 Ayes, Nays." The board directed that, because this is a Type I action, the negative declaration be circulated and filed on the Environmental Notice Bulletin. Cassidy said that, with adoption of the negative declaration, the subdivision application is considered complete and "they can move to their public hearing."
