Commissioners approved a staff-drafted advisory opinion after staff pointed to language clarifying the opinion applies to a specific fact set and does not shield respondents from complaint or sanction. The motion to approve the advisory opinion carried unanimously.
The commission also reviewed a Fresh Start Act submission from an applicant identified in materials as "Mr. Pedego." Staff explained the Fresh Start Act allows an early review limited to criminal-history determinations before applicants complete the full licensing process. Commissioners asked procedural questions about whether applicants must appear for informal appearance; staff said applicants only appear if the written materials differ from the TBI report. By motion, commissioners approved the Fresh Start preliminary determination.
On a separate item, commissioners considered a medical-waiver request (Mr. Davies) to waive late fees and retesting after the license expired on 03/15/2025. Staff advised the late fee would have been $1,100; the commission voted to approve the waiver, preserving the applicant's grandfathered status and allowing reinstatement without paying the late fee or retesting.
