The Waukesha City Plan Commission voted unanimously July 23 to approve a conditional‑use permit allowing Max Auto Care Plus to operate a gas station, convenience store and auto repair business at 461 West Sunset Drive in the B‑3 General Business District.
Staff presented the application and recommended approval with conditions, including addressing all staff comments and ensuring vehicles are parked only in designated stalls. Chair moved approval saying, "I'll make a motion to approve the conditional use permit for 461 West Sunset Drive, subject to staff comments, but also making it clear that vehicles, whether operating or non operating, must be parked in designated parking stalls." Commissioner Keller seconded the motion; the commission then voted aye and the motion passed.
In discussion staff noted the owner has operated the business for about 10 years and has already removed many vehicles from drive aisles, addressing prior site cleanup concerns. Staff and commissioners stressed enforcement and that the auto‑repair and gas uses are conditional in the zoning district, unlike the convenience store.
The commission’s approval requires the applicant to resolve all staff comments and follow the parking and site‑management conditions before permits are issued. No members of the public spoke against the proposal during the public hearing.
