Corey, planning staff, described the application and recommended nine conditions — including limiting access to Lucky Nugget Road, hours of operation from 4:00 a.m. to 8:00 p.m., a 6-foot privacy fence, grading and drainage plans sealed by a professional engineer, a dust-abatement plan, and compliance with Nevada Revised Statutes and county code. Staff noted the parcel’s history: a prior zoning change was overturned on appeal, which had nullified a prior conditional-use approval.
Residents raised objections at public comment and during the hearing. Paula Moore said notices were late, reminded the commission of the prior 2023 denial and warned that heavy mining traffic and single-access roads make the site inappropriate for a commercial operation that could increase noise and block access. She asked whether food trucks would remain on site overnight, whether they would serve alcohol, and how restrooms would be handled.
Applicant Robert Cundy (represented in the hearing by speaker 15) said the 3.24-acre lot would likely host food trucks only occasionally during summer, that generator noise would be minimal compared with traffic, and that he planned a privacy fence and on-site trash pickup. Commissioners asked about enforcement and whether the CUP should be time-limited; staff proposed a 24-month review to evaluate conditions, and commissioners included that review in the approval.
The commission’s motion to approve included staff recommendations with two modifications: limit the required privacy fence to Chukar only (remove the other two fence sides) and have the commission review and renew the staff report in 24 months to confirm compliance with conditions. The motion received a second and passed by voice vote.
