Chair David Webster called for the request to be placed on the record and asked Joseph to confirm the timing request and waiver of appeal timing issues.
Chair David Webster asked Joseph "to clearly state for the record that they requested the delay and will not raise the 30 day requirement upon appeal of the BCA decision." Joseph responded that "they will waive the 30 day requirement." Member Lee Suskin moved to accept the appellant's request to postpone the matter until Aug. 31, 2026, or a reasonable time thereafter, and to accept the appellant's statement regarding timing; Jennifer Leopold seconded. The motion passed 13-0-1; Joan Lenes abstained.
Following that vote, Bill Deming moved to recess the hearing to Aug. 31, 2026 (or a reasonable time thereafter); Lee Suskin seconded. That motion also passed 13-0-1 with Joan Lenes abstaining. The board recorded the postponement and the recess rather than conducting the site visit or hearing at the Aug. 3 meeting.
