Willard City Council unanimously adopted Ordinance No. 2026-04, which allows the planning commission to grant deferments for sidewalks, curbs and gutters for small subdivisions of three lots or fewer that meet specific criteria.
City Attorney Amy Hugie said deferments are limited to small subdivisions adjacent to paved roads built to city standards, where no new street dedications are required and public works has reviewed the project. If the commission grants a deferment, deed restrictions must be recorded so the city can require and collect payment for future installation; the ordinance includes lien rights and interest on unpaid assessments consistent with state law. Council added an interest provision as discussed before voting to adopt the ordinance.
The measure aims to make development in older town areas more practical while preserving the city's ability to require infrastructure when neighborhood conditions make it appropriate.
