The Willard City Council unanimously adopted Ordinance No. 2026-03, which removes performance bonds as a method for guaranteeing subdivision improvements and requires developers to use escrow accounts or lines of credit dedicated to subdivision work.
City Attorney Amy Hugie explained the change aims to simplify administration and ensure consistent contractual language; the ordinance will provide a standardized subdivision improvement-guarantee form including exhibits for property descriptions, cost estimates, approved plans and insurance documentation. City Manager Jeremy Kimpton noted most developers already default to escrow or lines of credit, and the ordinance adds a 10% two-year warranty holdback released incrementally after engineer approval.
Council member Mike Braegger moved to approve the ordinance and Council member Rex Christensen seconded; the motion carried unanimously.
