Council approves The Orchards Phase 3 final plat after water-rights discussion

Willard City Council unanimously approved the final plat for The Orchards Subdivision Phase 3, a residential expansion near 300 South 300 West, after city staff and the developer discussed outstanding water-rights and infrastructure matters.
City Planner Madison Brown said all requirements for final plat approval appeared to be in order pending completion of improvements, engineer sign-off and an escrow agreement. Developer Garth Day told the council that “206 acre feet of water had been verified by the state, and the city would be owed approximately 50 acre feet for phases 1, 2, and 3.” Council members and staff discussed whether the city preferred a 50-acre-foot transfer now or additional rights to apply against future fee-in-lieu open-space requirements; Mayor Travis Mote indicated 50 acre feet would suffice for the immediate approval with future negotiations possible.
Council members pressed for clarity on groundwater and geotechnical risks after Mayor Mote flagged a wet spot behind an old milking parlor in the development area. Day said the developer had worked with city engineer Zach Burke and was conducting enhanced geotechnical studies intended to mitigate risks for future basements. Council discussion also noted that Phase 3 represents the limit of current sewer capacity and that later phases cannot proceed until the Deer Run subdivision completes a northern sewer connection.
Council member Rodney Mund moved to approve the final plat and Council member Mike Braegger seconded the motion; the motion carried unanimously.
