A bitterly contested debate over how to fill the vacant commissioner of public works spot ended Tuesday with the City Council voting to formally request a county political calendar for a special election and to seek a written city-attorney opinion on the lawfulness of the timing.
Councilmember (speaker identified in the transcript as the mover) brought a resolution asking the county to set the special-election calendar; after extended floor debate about charter timing, petition deadlines and the cost of off-cycle elections, the motion was amended to make the request "subject to advice from our city attorney indicating the special election is lawful and in accordance with New York State law" and to request that opinion be issued by Oct. 1. The amended resolution passed by voice vote.
Residents who spoke during public comment repeatedly urged a prompt election, saying the Department of Public Works cannot operate indefinitely without an elected commissioner; other speakers warned of legal challenges from political operatives if state law and the charter are not followed. The council asked the clerk to request a timeline and cost estimate from the county board of elections so the city can evaluate logistics and budget impacts.
City attorney staff said they will research election law and, if necessary, seek outside election-law expertise or an Attorney General opinion to resolve legal uncertainty. In the meantime the council discussed moving forward on a concurrent path to form an interview committee to identify interim candidates, subject to later action once the election timeline and legal advice are in hand.
