The Shapley Planning Board voted to table a permit application for work on the Leonard Spallone property (presented by the applicant) after board members found the plan as submitted would exceed the 30% expansion cap for nonconforming shoreland structures.
The Chair led a line-by-line review of the plan and the board’s calculations, noting the proposed structure dimensions and a 12-by-12 bump-out. The Chair said, “I’m gonna keep going because we’re off 23 feet, so we have to fix that,” and members recalculated the figures until several agreed the proposed build would exceed the ordinance allowance (board members converged on roughly 33 square feet over the 30% limit). The board instructed the applicant to return with corrected footprint math and a clearer plan showing existing vs. proposed square footage before any signatures or recording would occur.
Separately, board members found the submitted revegetation plan lacked required professional detail. The plan lists native species and a 10-foot mulch band but does not show planting densities or maturities sufficient to guarantee five-year survival and infiltration. Under ordinance 10551.3 the board said the plan does not yet meet the ground-vegetation standards; the Chair and members asked for a scaled planting plan prepared or certified by a qualified professional and clarified planting quantities and spacing.
Action: the board moved and passed a motion to table the Spallone application pending corrected expansion calculations and a revised, professionally detailed revegetation plan. No occupancy or recording will be permitted until those items are resolved.
