Town adopts FOIL employee-notification policy to comply with 2024 amendments

The Town of Constable adopted Resolution #6-2025 to implement a policy for notifying public employees when the town releases employment-related records in response to FOIL requests under the September 2024 amendments to the Freedom of Information Law (Chapter 302, Laws of 2024). Supervisor Onufer explained the policy purpose and the board approved the resolution on a motion by Councilman Tom MacDonald, seconded by Councilman Clyde Wilson.
The policy follows guidance from the New York State Committee on Open Government (FOIL AO 19867) and requires notice to current and former employees (to last-known address when applicable) after records are released. It clarifies notification content and delivery methods and applies the POL definitions for disciplinary records. The motion passed with Lemire, Wilson, MacDonald and Supervisor Onufer recorded as Yes; Councilman Michael Leahy was absent.
