The board approved a resolution authorizing the ROC ONE Risk Operations Center (RIC ONE) and its designated attorneys to negotiate and approve Data Privacy Agreements (DPAs) with vendors and third‑party contractors that include requirements of New York State Education Law Section 2‑d and Part 121 regulations concerning student personally identifiable information and certain APPR data. The resolution notes the ROC's partnership with NYSED, the Access4Learning Student Data Privacy Consortium and The Education Cooperative to develop Ed Law 2‑d compliant contracts.
The resolution, moved by James Stachewicz and carried 4–0, states that the DPAs are presented to school districts and/or BOCES for final execution and do not require additional district expenditure beyond budgeted funds. The board granted the ROC and its attorneys authority to negotiate terms and take actions necessary to effectuate the DPAs.
