Planning Commission backs annexed Enclave at Lake Myrtle with PD‑H2 zoning

City Planner Jesse Pearson presented the request as a City‑initiated action to establish Low Density Residential future land use and Planned Development — Housing 2 (PD‑H2) zoning for the site, accompanied by a binding site plan that shows 15' front, 5' side and 10' rear setbacks.
Commissioners debated whether accepting the subdivision’s narrower county‑approved setbacks would set a precedent. Commissioner Dave Holt questioned bringing county‑developed lots into city limits with smaller setbacks, and Community Development Director Julie Womble responded that because the properties were developed under Polk County rules and voluntarily annexed, "If they have a house that is setback 15' we cannot tell them, you have to move your house 10' feet." Staff said adopting the existing setbacks avoids creating nonconforming uses that would otherwise arise if the city imposed its standard yards after annexation. The commission voted 5–1 to recommend the Future Land Use amendment and, separately, 5–1 to recommend the Zoning Map amendment; Commissioner Dave Holt cast the lone dissent on both motions.
