Planning commission recommends conditional use permit for Oxford House recovery home at 7 Darlene Lane

Saul Gleiser, the staff presenter, outlined the application (CU2026-0005) by Virginia Homes LLC with Oxford House as the applicant to operate a recovery home at 7 Darlene Lane, a 0.22-acre R‑3 parcel. Gleiser said the city's zoning ordinance defines recovery homes and permits them only with a conditional use permit, and staff recommended approval with conditions including that the dwelling have no more than six adult residents and that one of the first-floor bedrooms be restored to a communal living area.
An Oxford House representative, who identified himself as a staff member of Oxford House Incorporated, told the commission the house opened in 2024 and currently houses eight residents. He asked the commission either to grant a reasonable accommodation to allow occupancy of eight residents or to approve the permit as requested for six. "This isn't just a local zoning question. It's a fair housing question," the Oxford House representative said, arguing recovery residences perform well in research studies and that larger homes tend to have better recovery outcomes.
Commissioners pressed staff and the applicant on the investigation timeline and legal differences between recovery homes and state‑licensed group homes. Staff said a zoning investigation followed a referral and that a notice of violation was issued on Dec. 11, 2024, with a summons on July 1, 2025. Staff and the commission noted recovery homes are not licensed group homes and do not provide 24‑hour licensed supervision, so the city's higher occupancy allowance for licensed group homes does not automatically apply. Staff emphasized the local recovery‑home rule is intended as a reasonable accommodation that allows six unrelated persons in such dwellings.
After public comment and discussion, a commissioner moved to recommend approval of CU2026‑0005 with staff conditions; the motion was seconded and carried unanimously, recorded as an 8–0 vote. Miss Brown announced the case will be heard by City Council on Aug. 25, 2026.
The commission's recommendation directs the item to council with the 13 conditions in the staff report, including compliance with the Oxford House manual and annual resident certification to the Department of Planning.
