The Cold Spring Zoning Board of Appeals voted to hold a public hearing on an application to replace a backyard shed with a proposed 17-by-20-foot garage at 51 Parrot Street on Aug. 26, 2025, at 7 p.m. Chair Eric Borth made the motion and a board member seconded; the motion carried on a voice vote.
The applicant, Matthew, told the board the new structure would be a single-door two-car garage with a pedestrian door at the rear and estimated the peak height at about 12 feet. The chair noted the application shows the proposed garage would sit three feet from the side property line and read relevant language from the Cold Spring zoning code (noting §0.134-17) that sets a 5-foot minimum side setback in the RO district and a 12.5-foot combined side setback requirement.
"We don't evaluate your application. You don't have to defend it," Chair Eric Borth told the applicant during the workshop, explaining that the board's workshop step is a completeness review that prepares the record for a public hearing. The board asked the applicant to bring comparative measurements of the existing shed and the published plans, plus photos or satellite images so members can assess neighborhood context and bulk impact.
Applicant Matthew said his surveyor firm, Beatty and Watson, marked the parcel and that the marked plan shows a three-foot setback; he also said the contractor requires about 3 feet of clearance to build in the current location. The board instructed the applicant to make mailed notices to immediate neighbors, post the required sign no later than 10 days before the hearing and bring an affidavit at the hearing confirming the sign was posted.
The hearing was set after the board reviewed mailing, sign-posting and newspaper-publication timelines that require at least 10 days' notice; the chair said the village will publish a notice and he will send the applicant a one-page mailing notice and instructions. The hearing will be held at the board's regular meeting on Aug. 26, 2025, at 7 p.m.
