Board adopts sweeping Policy Update 126 and revised operating procedures amid trustee concerns

The Pharr-San Juan-Alamo ISD Board of Trustees voted to adopt a comprehensive set of local policy revisions compiled as School Board Policy Update 126, which incorporates statutory changes from recent Texas legislation including SB 12, HB 1522, HB 150, SB 706, SB 571 and related provisions. Assistant Superintendent for Human Resources Dr. Rebeca Garza and School Board Attorney Ben Castillo presented the package and explained the intent to align local policy language with new state requirements.

The policies change multiple local codes: meeting notices and agenda deadlines, public comment locations and timing, grievance timeframes, background checks and reporting requirements, cybersecurity and artificial intelligence training, personnel nonrenewal grounds (including engagement in duties prohibited by law), and parent-review processes for instructional materials. "We offer for consideration language requiring that agenda items be submitted 10 calendar days before a meeting," Dr. Garza said, explaining the operational aim of meeting deadlines. After Q&A the Board approved the update unanimously.

Separately, trustees debated and approved updated Board Operating Procedures (BOPs). Several trustees voiced concern that the BOP language could chill personal speech by elected trustees. Trustee Cynthia Gutierrez said she was concerned after the vote and characterized prior uses of process as punitive in some instances: "This censorship. Plain and simple," she said in her remarks after the vote. Other trustees, including President Ricardo Rodriguez and Trustee Carlos Villegas, said the procedures provide needed guardrails to ensure decorum and protect employees from defamatory or harassing conduct. The board voted to adopt the updated BOPs; the transcript records mixed views and at least one formal objection and a request to publish the procedures for public review.
