Homeowner granted variance to legalize sport court at 1 Windmill Court; drainage work required

The Zoning Board of Appeals approved an area variance Aug. 6 allowing an existing sport court at 1 Windmill Court to remain despite exceeding height limits.
Applicant Keith Arner told the board the court was installed during the COVID period on advice from a now-defunct contractor and that the family seeks to legalize it now. "So we're looking for a variance of 17 feet 10 inches," Arner said. Board members asked whether required permits had been sought; Arner said he will secure permits and that the building inspector required a drainage plan. He told the board, "The drainage is going to cost about $100,000." Neighbor outreach was reported; at least one immediate neighbor (identified as the Blums in the hearing) indicated no objection.
After board discussion and a motion, members voted to approve the variance. The board advised the applicant to complete the drainage work and pursue the required building permit following the variance approval.
