Chair says city counsel found recall provision inapplicable to school board members

The chair opened an informational report on a legal review, saying the city's corporation counsel concluded Bristol’s recall provision cannot be used to remove elected members of the Board of Education. The chair read that "the petitions issued under that provision are null, void, and of no legal effect," citing Connecticut law.
The chair said the determination rests on "long standing Connecticut law recognizing that when carrying out educational responsibilities, board of education members act as agents of the state," and noted the mayor referred the matter to corporation counsel for formal review. Copies of the ruling were made available to the public, the chair said.
