Mendocino CSD approves conditional will-serve letter to Kidwell Trust for 11520 Road 500 D

The Mendocino City Community Service District voted April 27 to send a conditional "will serve" letter to the Kidwell Trust for the parcel at 11520 Road 500 D, allowing the property owner to pursue required approvals from other agencies.
Chair Andrea (board chair) introduced the request and emphasized the letter is not a commitment to provide service. "Importantly, this is again, this is not an agreement to provide service," Andrea said, adding that final service would require fulfillment of conditions and later board action. Applicant Ed Powers identified himself in the meeting as the property representative. "I'm the applicant," Powers said during public comment.
Staff described the draft letter as a step that permits the property owner to seek approvals from the Local Agency Formation Commission (LAFCO), obtain state parks' consent to tie in to the existing line, secure county land‑use consistency, and execute a service agreement that would include indemnification and payment of district costs. Jeff (staff) told the board the district had not independently verified the property's chain of title or zoning and that the applicant would bear the costs of any infrastructure tie‑in.
The board discussed a two‑year time limit in the draft with a possibility of extension and noted the district lacks control of the State Parks line linking to MCCSD's system. After public questions and some clarifications from counsel and staff, Chair Andrea moved to approve sending the conditional will‑serve letter; the motion was seconded and carried. The board authorized the superintendent to transmit the letter with any non‑substantive edits approved by staff and counsel.
Why it matters: The letter lets the county and other agencies consider the applicant's planning application without the district committing to final service. Any final extension of service would require LAFCO approval, any necessary permits, a negotiated service agreement, and a separate board vote.
