County staff takes neutral stance on Green Meadows rezoning, cites aquifer and compatibility concerns

Blatt Finkel, who introduced himself as representing Cooney County Community Development, walked the hearing through staff’s technical review of Green Meadows LLC’s application to rezone a 1.67-acre parcel.
"The property is located, over the aquifer in a more flatter area of the county," Finkel said, noting Panhandle Health District wastewater discharge limitations that constrain on-site uses. He described the applicant’s conditional zoning development agreement (CZDA) as the appropriate legal instrument to set sideboards on future uses.
Finkel told the hearing that staff initially raised compatibility concerns during a pre-application meeting and that staff’s formal report takes a neutral position because the current record does not provide sufficient evidence to support one of the required findings under the county code (referenced in the transcript). He also pointed out that the parcel is nonconforming under the agricultural zone because the minimum lot size for that zone is 5 acres.
The staff presentation likewise described surrounding uses — agricultural fields and mining to the west — and noted nearby municipal area-of-impact boundaries. Finkel recommended that the examiner ask the applicant to clarify how the CZDA would address compatibility if the examiner felt it necessary to resolve staff concerns.
