Hearing examiner Marcus Johnson opened a public evidentiary hearing on case ZON26-0002 and said he would receive testimony and submit a written recommendation to the Kootenai County commissioners within 14 days.
"My name is Marcus Johnson, and I am the hearing examiner this evening," Johnson said at the outset. He emphasized that the examiner issues a recommendation only and that the county commissioners make the final decision.
Blatt Finkel of Cooney County Community Development summarized staff’s review of Green Meadows LLC’s application to rezone a 1.67-acre parcel from agricultural to light industrial and described the submitted conditional zoning development agreement (CZDA) as the mechanism the applicant proposed to limit future uses. Finkel told the hearing that staff is taking a neutral position because the record currently does not supply sufficient evidence to meet a required compatibility finding under the applicable county code provision referenced in the record.
The examiner closed the evidentiary portion after hearing no public testimony and said a written recommendation would follow. "I will have a written decision within 14 days," he said.
The matter now moves to the commissioners, who will consider the examiner’s recommendation and any additional materials before making a final decision.
