The Town of Babylon Zoning Board of Appeals approved application 26135, allowing a rear-yard deck and gazebo at 226 Marcy Street in West Babylon while imposing conditions that bar further enclosure of the deck and permanent side enclosures for the gazebo.
Applicant Joseph Orsina said the outstanding issue arose during a title search that revealed an open permit and that he has already removed a shed. The board confirmed receipt of planning and survey materials and asked that the applicant upload photos documenting the shed removal. Mr. Orsina told the board, "It's my phone" when asked about photos and agreed to upload evidence to the portal.
Board member Mr. Shepherd moved to approve the application with the conditions in the planning memo; the motion was seconded and recorded as approved. The board noted that approval does not replace the need for a building permit from the building department before work can proceed.
