Town Board closes multiple dock and dredge hearings, declines referral on one dock application

At its Feb. 2 meeting the Shelter Island Town Board handled multiple public hearings on wetlands, docks and dredging. The Board closed the hearings for 31B Dickerson Drive and the Seagull Road Channel dredge, closed the 2 Charlie's Lane dock hearing after presentations, and left the 74 Peconic Avenue (O'Sullivan) wetlands hearing open for one additional week of written comment.
During the 31B Dickerson Drive proceeding, Town Attorney Thomas Crouch advised that an existing 2002 covenant prohibiting enclosing or roofing a deck would not apply where the existing deck is being removed and a new deck built; the Board accepted that legal opinion and closed the hearing. For 2 Charlie's Lane, agent Jack Costello and applicant Harry Totonis said the longer dock length was necessary because "shortening the dock would result in insufficient water depth at low tide," and the Board — over Councilman Albert Dickson's request to return the application to the Waterways Management Advisory Committee (WMAC) — declined to re-refer the application. For the Seagull Road Channel dredge, Costello noted dredging occurs every couple of years and spoils are placed in a designated area; the Board closed the hearing.
