Staff (S2) informed the board that the Okoboji easement closing, which had been near completion in November, has been postponed after a neighbor filed a lawsuit against the homeowners association raising a competing ownership claim. Staff described the situation as a title issue created by ongoing litigation between the neighbor and the HOA and said attorneys on both sides are working to resolve it.
"The neighbor...is claiming that they own the property since they were managing it for so many years," staff said, explaining the root of the dispute. The board was told staff and the land-trust attorney will coordinate with the property attorney to clear title before proceeding; no new closing date was provided.
