The Osceola City Council approved Ordinance 702, adding Section 136.20 to allow limited sidewalk sales, retail display and outdoor dining in the 100 blocks of South Main Street, West Jefferson Street, South Fillmore Street and West Washington Street. Council Member George Fotiadis moved approval of the second reading and Council Member Sonya Hicks seconded; the council waived the third reading and the motion carried unanimously.
The ordinance permits businesses within the specified blocks to use up to six feet of sidewalk immediately adjacent to the building face for outdoor dining and seating, sidewalk sales and associated furnishings, provided the use does not create a hazard or obstruct entrances. The text authorizes the City Administrator to temporarily suspend or restrict sidewalk use for public construction, maintenance, special events or emergencies and contains an indemnification requirement for businesses. "Any business located within the applicable area may utilize up to six (6) feet of the public sidewalk immediately adjacent to the building face for: A. Outdoor dining and seating B. Sidewalk sales and retail display of merchandise C. Associated tables, chairs, racks, and similar furnishings," the ordinance reads. The council directed implementation per the ordinance's administrative standards.
