Marlborough board authorizes law firm to sue property owners over alleged zoning violations

The Town of Marlborough Board on June 3 authorized the law firm Van DeWater & VanDeWater, LLP to file an enforcement action in New York State Supreme Court against multiple property owners and tenants alleged to be operating in violation of a March 11, 2025 Stipulation of Settlement and the town zoning code. The board’s Resolution #63 permits pursuit of injunctive relief, damages, fines and other remedies and designates the matter as a Type II action under SEQR.
Supervisor Colleen Corcoran stated that “based upon information provided by the attorney for the town, including observations of the building inspector, we have before us a draft resolution to bring an enforcement action” against owners and tenants at properties listed on Mount Rose Road and James Street in Marlborough. The resolution names several defendants explicitly, including SOMEPLACE UPSTATE LLC, ROSEVINE LLC, BELLFLOWER GROUP LLC, ARI MATITYAHU, ADAM H. J. BROZA, and DANIELLE L. BROZA a/k/a DANIELLE L. STEINBERG, and authorizes Van DeWater & VanDeWater to represent the town and bill at $295 per hour.
The resolution directs the supervisor to sign any documents necessary to effectuate the authorization. The board recorded a unanimous vote of those present: four yes, zero no, with Councilman Molinelli noted as absent. The minutes certify adoption and include the town clerk’s attestation.
