Commission considers requiring developer bonds to protect county roads

County staff and County Attorney Clyde Richard presented a draft resolution that would require subdivision developers to post bonds to cover potential damage to county highways caused by construction-related traffic.

Richard said county staff reviewed other jurisdictions and found limited precedents; Williamson County was cited as having a limited bond procedure. "If you pass this resolution tonight, the highway department will require a bond on the front end for repair of the county road because of that," Richard told the commission.

Under the draft, the highway department and the highway superintendent would accept the bond and be responsible for enforcing repairs after project completion. Commissioners asked who would oversee enforcement; Richard said it would rest with the highway department and the highway superintendent.
