Planning Commission wrestles with data center ordinance: setbacks, noise thresholds and decommissioning

Scott Maldonado, lead land specialist, presented proposed changes to a model data center ordinance for the I‑2 zone and solicited commissioner input. Commissioners raised technical and policy questions: why trails and national trail corridors were excluded from sensitive‑receptor definitions, how a 67 dB daytime / 57 dB nighttime noise standard would be measured and enforced, and why Section 3 would only apply to buildings 100,000 square feet and larger. Maldonado said the draft language followed the model ordinance and that details such as testing protocols, fencing height, and enforcement mechanisms could be added in the final version.

Commissioners and residents pressed a series of specifics. Commissioner Adrian Arnold and resident Clarence Bouchat asked for stronger protections for regional/national trails and more clarity about decibel testing; Commissioner Ron Secary questioned requiring traffic studies tied to the 'most intensive' ITE land‑use code for a low‑traffic use. Commissioners discussed decommissioning — including time deadlines and financial assurances — and whether a recommended 500‑foot setback from residential districts or sensitive receptors might be overly restrictive compared with a currently proposed 25‑foot buffer. Commissioners asked staff to refine definitions, testing protocols, fencing and lighting standards, and financial‑assurance language before the ordinance returns for further review.
