The council considered Resolution 2024-10 to authorize the mayor to execute documents for the third amendment to the development agreement with Rock Garden Holdings, LLC. Developer Chris Anderson said he was searching for a tenant and could begin civil work including power, site drainage, water/sewer connections and underground work.
Anderson estimated the civil work investment at "approximately $300,000." Councilmember Frank Herbert moved to amend the contract to require completion of civil components by Nov. 22, 2024 to unlock a one-year extension to Nov. 22, 2025; the amended motion carried with Herbert, Harding and Henne voting in favor and Poole abstaining.
