Commissioners ask whether administrative use permits that trigger CEQA must be elevated to the commission
Summary
A commissioner asked whether an administrative use permit (AUP) that requires CEQA review must be heard by the planning commission; counsel and the chair said administrative permits are often CEQA-exempt but non-exempt items requiring mitigation or findings would be elevated for commission review.

A commissioner asked whether an administrative use permit (AUP) that triggers CEQA review must come before the planning commission. Chair Hailey Lang and counsel clarified that CEQA review is required for projects and that many administrative use permits are typically exempt; however, if an exemption does not apply and mitigation or findings are required, the item would be elevated for planning commission review.
As Chair Lang summarized: "With CEQA, right, anything that's a project needs CEQA review." The exchange underscored that while AUPs are intended to streamline approvals at the director level, CEQA compliance remains a legal obligation and non-exempt projects will likely proceed to the commission for public hearings and required findings.
Commissioners emphasized the importance of clear draft language to avoid procedural confusion about when director-level approvals are appropriate and when items must be escalated because of CEQA or mitigation needs.
