Staff told the commission the lot is legally nonconforming and that the parcel's geometry and setback requirements (including a required front-yard setback measured from the road centerline and a 100-foot rear-yard buffer from residential) leave little usable land without variance relief. Commissioners noted the lot does not meet minimum lot-area requirements for commercial zoning absent sewer access and that rezoning could leave the owner in a worse practical position if relief is not granted by the Board of Adjustments. One commissioner said the lot's limited current value under existing zoning raised concern about fairness, but a majority concluded the proposal did not conform to the master plan and applicable ordinance standards.
Owner Mark Robinson said he had no immediate plan for the site and described it as effectively unusable without relief; staff and commissioners discussed potential remedies such as a variance application to the Board of Adjustments but proceeded to vote to deny the rezoning request.
