Harrington summarized the negotiated conditions: the developer must install a water-line connection to Vernal City infrastructure; property owners seeking to avoid double taxation must initiate withdrawal petitions from Ashley Valley’s service district; Vernal City will provide water meters and will waive additional impact and meter fees for properties that already paid such fees to Ashley Valley; and Ashley Valley may use previously collected fees to cover transition costs. Harrington said the annexation ordinance is expected to come forward after a 20‑day appeal window and the 30‑day statutory waiting period.
Councilmembers expressed general support for the collaborative approach. Councilmember Randel Mills said the annexation supports housing development, and Mayor Corey Foley — who participated on the Boundary Commission — flagged inefficiencies created by multiple water districts operating in the same area. Councilmember Ed Long questioned whether attaching non‑statutory conditions to annexations could complicate future cases; Harrington said the Boundary Commission found conditions appropriate given the issues presented. Public commenter Allen Hacking raised concerns about fire-flow capacity; Public Works Director Keith Despain said appropriate testing would be done. Developer Michael Eskelson addressed water‑availability constraints and expressed support for proceeding under the negotiated conditions.
