Board looks to bond Beta excavation stockpiles unless owner shows alternate guarantee

Board members expressed concern that temporary stockpiles retained on airport property could leave developed land in an undevelopable state if left indefinitely. Staff noted the airport lease includes a capital reserve intended for restoration, but several members argued a dedicated bond is the most reliable mechanism to ensure site rehabilitation.
Chris Gendron said the airport tenant arrangement includes a capital reserve and that Beta could provide additional evidence of a financial mechanism. The applicant proposed a two-year window (through fall 2028) to hold materials on-site before removing them if not used for subsequent on-site development.
Chair Dawn Filibert said: "We will require a bond unless the at the next step of the hearing, you come back to us and convince us that that's not necessary." The board asked the applicant to work with staff to quantify a bond amount based on the restoration plan and to submit that information before the May 5 continuation.
