Law Director Jeffery Forbes told the council he is tracking House Bill 109 in the state legislature, which at the time of the meeting proposed restrictions on local rules for short-term rentals including owner-occupancy requirements in residential zoned areas and a maximum $20 fee. He warned that the bill remains in committee and that changes are likely before final enactment.
When Council member Zack Gallagher asked whether Home Rule could preserve the village's existing regulations, Forbes said it was a "wait-and-see" situation dependent on courts and the bill's final language, and added that Home Rule does not apply to laws that courts determine must be uniform statewide. He said he will continue to monitor the bill and report back to council.
