City staff presented a second ordinance nearly identical to the Langley item to grant Dominion Energy a nonexclusive easement across city-owned property at the Bethel Landfill (100 North Park Lane) to serve the Virginia Department of Transportation (VDOT). Staff said the city complied with public-bid requirements and recommended accepting Dominion's bid.
The mayor opened the required public hearing; no one signed up to speak. Council moved and seconded the item. During the roll call clerk: Councilman Bowman voted Aye; Vice Mayor Brown Aye; Councilwoman Campbell Aye; Councilwoman Farabee Aye; Councilwoman Harper Aye; Councilwoman Mugler Abstained; Mayor Gray Aye. Councilwoman Mugler had earlier stated on the record that, "In accordance with section 2.2-3112(a) of the Virginia Conflict of Interest Act, I am disqualified from participating in the consideration or voting on items 4-2661 and 5-2662 because my spouse is engaged as a paid lobbyist for Dominion Energy, Virginia." The item passed with Mugler abstaining.
Staff advised that the matter follows statutory procedures for city-owned easements and that execution of the easement document will follow council acceptance.
