Town attorney seeks ordinances to align Huachuca City code with state firearms law

The Council authorized the town attorney to draft ordinances amending three town-code sections to comply with state preemption of firearms regulation and remove provisions the town can no longer enforce.
Town Attorney Thomas Benavidez told the Council that certain town-code provisions currently restrict activities the state now permits and recommended preparing ordinances to bring local code into compliance with state law on firearms. He identified Section 18.100.210(D)(1) (Weapons Merchant Prohibited Home-Based Business Use), Section 9.20 (Minors Prohibited From Carrying Firearms), and Section 2.55.070 (Fees Chargeable By Police Before Firearms Transfer) as sections to be reviewed.
Mayor Johann Wallace moved to authorize preparation of the ordinances and the motion was seconded; the Council approved the authorization unanimously. Benavidez explained that the drafts would be prepared for later Council consideration and that the purpose is to bring town code into alignment with state statute.
