Administrator: Enbridge lawsuit could require Cass County taxpayers to repay roughly $298,862

County Administrator Joshua Stevenson briefed the Board that Enbridge has filed a lawsuit against the State of Minnesota seeking property-tax relief tied to pollution-control mitigation. He told commissioners the numbers derived from Department of Revenue settlements and the company’s requested mitigation credits indicate Cass County taxpayers may need to reimburse about $298,862 under a 10.4% payback scenario and an additional $172,421 under a 6% payback; he added that other taxing jurisdictions in the county could face about $1.1 million in repayments.
Following the briefing, Commissioner Neal Gaalswyk moved to approve an OPED for distribution to local media and taxing jurisdictions so those entities would be informed of the potential fiscal impact. The motion passed unanimously. The Board did not adopt policy changes at the meeting; the OPED is informational and intended to notify local taxing districts of the possible liability stemming from the state-level appeal.
