Council approves 5995 Heath Road rezoning for indoor pickleball facility with conditions and stormwater caveats

The City Council voted to approve a plan amendment and rezoning—subject to amended conditions—for a proposed indoor pickleball facility at 5995 Heath Road on Aug. 6, 2026.
Staff described the request as a plan amendment to the Northwest community plan and rezoning from C1 to C2NA with proposed conditions. Applicant representatives said the facility would be fully enclosed and that they agreed to conditions limiting alcohol sales, outdoor amplified sound and lighting pole heights. "The requested base of C2 is to allow for a consolidated building rather than multiple small buildings," said Emily Weisler, who represented the property owner and described amendments restricting alcohol and outdoor sound.
Several neighbors, including Rose Ryan, presented slides and petitions opposing the C2 upgrade. Ryan said the property sits in a flood-prone area and warned of four acres of impervious pavement and nighttime light and noise intrusion affecting a largely low-density residential neighborhood. "Heath Road is completely underwater," Ryan said while showing flood photos from July 4, 2026. Council members discussed the need for stormwater mitigation and resiliency work and Councilman Galvan moved to approve the item as amended with the stated conditions; the motion carried by voice vote. Council members indicated the developer will need to coordinate with public works and the HOA on additional mitigations.
