The Greenburgh Planning Board voted to classify ACPI 2 Fairview LLC’s application for a wetland/watercourse permit at 102 Fairview Park Drive as a local Type 1 action and to adopt a SECRA negative determination, clearing the way for the board’s conditional approval of the permit.
Deputy Commissioner Schmidt, presenting staff recommendations, walked the board through the site‑specific conditions included in the draft decision. He told the board that “the applicant shall apply for and obtain a water course protection permit pursuant to chapter 2 70 of the town code prior to filing for a building permit.” He also recited the stormwater conditions, including the requirement that the applicant submit for a stormwater management permit under chapter 2 48 and, if required by the town engineer, execute and record a stormwater maintenance agreement with the Westchester County Clerk.
Board members asked about maintenance of oil‑water separators and whether those schedules tracked recommendations from the Conservation Advisory Council; Schmidt confirmed those items are reflected in the stormwater management permit and will be enforced by the town engineer and town attorney. The approval requires the town engineer to confirm the applicant’s system is designed to handle a 50‑year storm event as represented by the project team.
After a short discussion and minor clarifications to the draft decision, the board moved, seconded and approved the SECRA determination and the wetland/watercourse permit as amended by the site‑specific conditions. Chairperson Pine recorded the vote as unanimous. The draft decision directs that permit conditions be incorporated into the approval letter and that numbering/address information be clarified on the cover page for public clarity.
What comes next: the applicant must satisfy the listed administrative requirements — including the watercourse protection and stormwater permits and any required recording of maintenance agreements — before filing for building permits.
