Planning board approves shoreline retaining-wall replacement with revegetation and BMP conditions

The Planning Board reviewed a conditional-use permit to replace a nonconforming retaining wall located within the Shoreline District, with plans dated 06/04/2026 (Joseph Stanley). Chair read standards under §105-49 and noted maximum observed dimensions and that the wall length on the water side is approximately 74.9 feet. "Maximum height observed is 2.10," the Chair said while confirming the height and run of the wall.
The board required a detailed revegetation plan using only native species (mount laurel, lowbush blueberry, sweet fern among those listed), and it emphasized a minimum survival rate of 80% for planted trees and saplings over five years. Erosion-control best-management practices (BMP) including a minimum 4-inch depth of erosion-control mulch, silt fences and stabilization measures were conditioned on approval. The Chair read conditions requiring a licensed surveyor to confirm final placement, removal of debris from town and disposal off-site, DEP-certified personnel for erosion control unless the homeowner performs the work in full, and photographic proof of stabilization within 20 days of completion.
The Chair called for a motion: "I will take a motion to approve the con replacing the wall with the conditions that we just read." The motion was seconded and approved by voice. The board recorded the completion date requirement (06/10/2027) and reserved enforcement actions under §105-63 should conditions not be met.
