Chair opened consideration of a conditional-use permit for a proposed garage at Map 32 Lot 10, noting the plan includes gutters to stone dry wells, a stone drip-line trench and a colored "rain garden and driveway design". "The rain garden is approximately 6 by 10, which is 60 square feet each with at least 20 plants," the Chair said, summarizing the stormwater measures on the plan.
The board reviewed §105-73(g) criteria for conditional uses (wildlife, setbacks, comprehensive-plan consistency, erosion control, and wastewater). The applicant provided an updated subsurface wastewater application and a site plan dated 04/29/2026 drafted by Joseph Stanley, PLS, showing the existing leach field location. The Chair read conditions requiring a licensed surveyor to confirm the final placement, that the approved plan be recorded in the York County Registry of Deeds within 90 days, and that post-construction photographs documenting revegetation be submitted within 20 days of completion.
"I will take a motion to approve a 34 by 36 garage only, no bathroom facilities without further approval by the planning board, placing the garage at its closest point to the right of way at 25 feet for the plan drafted by Joseph Stanley, PLS number 2463," the Chair moved. The motion was seconded and approved by voice; no roll-call tally was recorded in the transcript.
Next steps: the applicant must file the recorded plan, provide the licensed-surveyor confirmation to the code-enforcement officer and planning board, install the approved stormwater/revegetation measures, and provide photographic proof of stabilization. If conditions are not met, the plan becomes null and void and a new application will be required.
