Council tables Sunrise Meadows preliminary plat after HOA raises legal question about Lot 401

Planning Technician Alexis Kline presented the Sunrise Meadows preliminary plat for a proposed 166-lot manufactured-home subdivision and summarized conditions negotiated with the Sunrise Bluffs HOA: a permanent 6.5-foot insulated sound wall along the northern boundary covering lots 1–29, a breakaway/crash gate at Track C with a Knox box for emergency access, underground utilities, a sewer lift station, and single-story limitations on lots 4–29 (lots 1–3 excepted to allow a potential two-story model home). Kline said the revised plat meets the 4,500-square-foot minimum lot-size requirement.
Several residents spoke during public comment. Rena Keith, Sunrise Bluffs HOA president, said the community broadly supported the negotiated conditions but had only received P&Z minutes that morning and was initially alarmed by a typographical error in the P&Z record. Maryanne Pincus raised a legal concern that Lot 401 may have been annexed into the Sunrise Bluffs HOA under CC&Rs governing a 55-plus community in March 2022 and submitted documentation to the county clerk. James Popovich asked about drainage from a rear arroyo and frontage-road conditions. The developer’s agent requested tabling to allow an in-person meeting with the community; another commenter urged the Council to proceed, saying the negotiated conditions were ready.
Councilors and staff acknowledged the outstanding legal question concerning Lot 401 and directed the item be tabled to the June 15 meeting to resolve the status; the motion to table carried 4-0.
