Council member Pooley told the board that “an investigation by the office of the city attorney has found that during the course of her tenure as a council member, Eva Lopez Chavez failed to maintain a primary place of residence within District 4,” and that the city recorder has formally notified Lopez Chavez that the seat is vacant under Utah law.
Executive director Jim Bruno summarized the statutory process that follows the finding, saying the council has 30 days to fill the vacancy and that staff will post application and notice details on the city website “early next week.” Bruno said the council could interview and select a replacement at one of its regularly scheduled June meetings — June 4, June 9 or June 11 — depending on the number of applicants and scheduling.
Pooley cited Utah code as the legal basis for the vacancy and asked staff to share a timeline and application details with the public. Staff said anyone meeting statutory requirements may apply and that the city recorder’s notice serves as the official communication on the matter.
