Shortly before public comment, Trustee Carlos Elizondo moved to pull Agenda Item VIII.B (Cummings property) out of closed session so the Board could discuss it in public. Board counsel Nick Maddox advised that while the Open Meetings Act commonly provides an exemption for real‑property negotiations, the statute also permits public discussion; legal issues, however, are commonly reserved for executive session.
"It's a specific exception to the Open Meetings Act because there's sensitive information regarding the negotiations whenever we are buying or selling," Maddox said, explaining why many districts choose closed session. After debate, the motion to move the item into public discussion failed on a 2‑4‑0 vote (Yeas: Carlos Elizondo, Frank Ortiz; Nays: Daniella Lopez Valdez, Denise Garza, Jessica Gonzalez, Marisa F. Leal). A later reconvened motion authorized the superintendent to negotiate in public session under specific conditions.
The failed motion highlighted trustees' differing views on transparency and negotiation strategy; several trustees said they wanted to protect bargaining positions while others argued for broader public involvement.
