City legal staff and the applicant's attorney briefed the council on an amended special-use permit for the Edgewater residential project, explaining the referral from the planning board to add two studio units (a net increase of two units and nine bedrooms in Phase 2).
The city attorney said the council is the approval authority for special permits in the RD zoning district and that the planning board has provided a supportive recommendation to set a public hearing. "The application has been referred to the city council from the planning board for an additional 2 dwelling units, which include 9 bedrooms," the city attorney said. Taylor Palmer, representing the applicant, confirmed the change increases the Phase 2 bedroom total by nine and said detailed unit-breakout information will be submitted to the record for the public hearing.
Council members asked whether the additional units could be required to be below-market-rate; staff replied this application differed procedurally from past cases and that no waiver or land-banking condition currently supports converting additional units to BMR. The public hearing was set so neighboring residents and other stakeholders can comment on the proposed amendment.
