Commission staff told the committee that the commission’s statutory powers do not include the ability to impose individualized penalties for employee noncompliance with the annual ethics training mandate. Executive Director Burland said the commission can provide aggregate compliance data to the legislature and governor but cannot currently impose sanctions on agencies or employees.
Burland and other staff described alternatives under consideration: publicizing agency‑level compliance (a "name and shame" component built into reporting), developing agency report cards, and encouraging agencies to incorporate training compliance into managers’ evaluations. Commissioners asked whether the commission could explore regulatory powers or legislative options for enforcement if voluntary mechanisms fail.
