Down Cape Engineering presented a Notice of Intent for an inground pool at 4 River Drive that will be sited in riverfront area, LSCSF and the buffer to a coastal bank. The plan uses woody plants for mitigation, marks the mitigation boundary with rock markers, and retains two adjacent trees. CA recommended mitigation be installed prior to construction because prior projects on the site had failed to install required plantings; the Commission agreed to allow construction to begin sooner but required mitigation to be planted by Oct. 15, 2026 and included annual monitoring and restoration obligations in the OOC.
Commissioner Bradford Bower moved to issue the OOC with special conditions, including a planting deadline and annual monitoring; the motion carried 6-0. The Commission noted the plan did not propose a drawdown pit due to pool size and required restoration of any vegetation damaged by site access.
