Staff presented a survey showing the garage sits 4.6 feet from the left side property line instead of the required 10 feet. Applicant Paul Gray admitted he built the structure without a permit and told the board he had poured concrete before learning about setback rules. "I throw myself on the mercy of the colony," Gray said during his testimony, acknowledging the mistake.
Board members reviewed existing permitted structures on the lot and cited accessory-building rules that allow a small accessory building to be closer than the standard setback only if it meets size thresholds. After discussion, the board voted against approving the variance; staff encouraged the applicant to meet with county staff to determine remediation options.
