Board approves multiple NIPSCO encroachments after revising exhibits and warning against prior boring damage

ACSO recommended approval of DOCs #26-146 (Stonebridge Business Park No.3), #26-147 (Graham McCulloch Br.4), #26-148 (Dennis No.2, Br.1) and #26-149 (Dennis No.2, Br.2). The motions passed with standard conditions that borings be a minimum of 5 feet below the lowest ditch grade or 3 feet below tile. Allen County Surveyor Mike Fruchey told the board one cause for reconstruction was that, in his words, "NIPSCO bored right through it," noting that prior boring damaged the original tile and that the new EC-4 Exhibit must reflect reconstructed alignments to prevent repeat incidents.
For DOC #26-148 and #26-149 the board approved the petitions subject to the modified EC-4 Exhibit showing the newly reconstructed alignment; ACSO staff confirmed the revised exhibits were received on July 1, 2026. Board members stressed that contractors must stay clear of the new pipe centerline and comply with boring-depth protections to avoid future damage and potential liability.
